USAGE CONDITIONS

Before using the Premium services offered by Kaise Telecom Solutions S.A. (hereinafter the "Company") shall carefully read these Usage Conditions. If these are not acceptable, do not access the Premium Services of the "Company" and immediately close this page, as the request or download of software imply the acceptance of these Usage Conditions.

WARNING: ACCESS TO THE PREMIUM SERVICE SHALL REQUIRE SENDING ONE TO THREE SMS PER DOWNLOAD. THE PRICE OF EACH SMS IS FOUR POUNDS EACH. The downloaded software will not change or ask to change the default url of your browser, also will not install or suggest the installation of any other application than the expressly downloaded.

ONE.- PURPOSE

1.1. These Usage Conditions regulate the high speed download of software, virus and spyware free (the "Service") by the "Company" to the user through the Website.

1.2. The Service allows users to download software available in the Website from the "Company" servers to the hard disk of the local PC; in exchange, the user shall send one SMS before each download in compliance with clause 2.2 of these Usage Conditions.

TWO.- SERVICE REQUIREMENTS AND OPERATION

2.1. The Service may be used by individuals of adult age or legal entities. In the first case, the user declares and guarantees he/she is of adult age and has full capacity to engage.

2.2. Prior to accessing the Service, the user shall send one SMS to the short number. Next, the "Company" shall send a code to the user's mobile phone providing access to the Service and download the selected software.

2.3. The user commits to comply with the instructions that the "Company" provides in the software download area of the Website while accessing the Service and downloading the software.

2.4. The price of each SMS sent by the user to the specified short number shall be four pounds; the total cost of access to the Service shall be four pounds.

THREE.- USER OBLIGATIONS

3.1. The user shall be exclusively responsible for the configuration of technical requirements to use the Service from his/her personal computer and/or mobile phone, as well as their maintenance.

3.2. The "Company" holds the industrial and intellectual property rights of the logos, brands, text, software, graphics, images or any other type of content included in the Website. In this sense, the user commits to comply and not perform any act that may breach the intellectual or industrial property rights of the "Company" or third parties. In this sense, the user shall abstain from altering, manipulating, copying, reproducing or perform any other act that may contravene the rights of the "Company" or third parties to the content, protection devices or copyright mentions included in the Website.

3.3. The user commits to not use this Website or the Service in any way that may damage, render inoperable, saturate or prevent its normal use by other users and, especially, to not hinder the operation of the Website and not saturate bandwidth or any other technical element that may be damaged.

3.4. The user shall not perform any action with the purpose of transmitting elements that may contain viruses, Trojans, logic bombs or any other element that may deteriorate, interfere or intercept the platform that provides the Service in full or in part.

3.5. The user shall indemnify the "Company" for any damages and losses, including in court or out of court legal assistance, that may be caused as a result of breaching the obligations included herein, as well as any other that may be applicable in accordance with these Usage Conditions.

3.6. The "Company" reserves the right to request the user at any time to justify the fulfilment of obligations defined in this clause and any other that may be applicable by virtue of these Usage Conditions. Furthermore, it reserves the right to cancel the user in the event he/she cannot accredit the fulfilment of its obligations.

FOUR.- PERSONAL DATA PROTECTION

4.1. Any personal data provided by the user to the "Company", by virtue of the request or engagement of services offered through the Website or at any time shall be included in personal data file owned by the "Company". The purpose of this file is the fulfilment and suitable management of relations between the "Company" and its users.

4.2. Furthermore, by providing his/her data the user expressly agrees they will be used to send commercial communications through any communications resource, including electronic or telematic, about products and services provided by the "Company" or Group companies. 4.3. Users may exercise their rights to access, rectification, cancellation and opposition with regards to their personal details by sending a written notice to the registered address of the "Company" located in ADR Tower, 8th floor, Samuel Lewis Avenue and 58th Street, Obarrio Urbanization. Panama City, Republic of Panama.

FIVE.- TECHNICAL SUPPORT

5.1. The "Company" provides users with a technical support service solely for the resolution of problems, incidents or questions related to the software download process. In order to access such service, the user shall send a notice in writing to the e-mail address: (see support section).

5.2. The "Company" commits to attend to incidents raised by users on the matters indicated in the previous paragraph of this clause. Under no circumstance, shall it attend to or resolve incidences regarding software that the user wishes to download or has actually downloaded. In the case that the user has some incident, problem or question related to it, it shall directly contact the developer of such software.

5.3. Technical support does not include user support in the preparation, maintenance and configuration of the necessary technical requirements for the use of the Service in their personal computer or mobile terminal, obligation that users shall assume in accordance with the provisions in clause 3.1 of these Usage Conditions.

SIX.- LIMITATION OF LIABILITIES

6.1. The servers and equipment property of the "Company" are suitable for the provision of the software download service subject to these Usage Conditions and offered through the Website. However, there are other network elements belonging to telecom operators and beyond the control of the "Company" that have an effect on service provision, and specifically, may affect download speed. In this sense, the user assumes and accepts that the "Company" shall not be liable when the download speed is slower than desirable due to reasons attributable to the network or third party elements.

6.2. The "Company" shall not be liable for deficiencies, delays or Service failures resulting from deficiencies, interferences, mobile network errors, lack of coverage of the mobile phone or any other reason attributable to the mobile operator or as a consequence of the manipulation or alteration of the user's mobile phone.

6.3. The website and systems of the "Company" have suitable technical and organizational security resources to guarantee the security and confidentiality of communications in compliance with quality standards of the sector. Furthermore, the "Company" has implemented controls to avoid the opening of security breaches, including in the Website and its system measures and procedures specific to minimize these types of risks. In any case, the user declares to be aware and accepts that the Internet security measures are not impregnable; reason why any communication sent through this resource may be intercepted or modified by unauthorized persons.

6.4. The user assumes and accepts that the Website may contain inaccuracies or errors that shall be corrected as soon as possible once they become known.

6.5. The "Company" does not guarantee that the information provided through the Website is complete and accurate, and therefore shall not be responsible for damages caused to the user as a result of accessing the Website or use of the Services. Furthermore, it shall not assume any kind of liability for products and/or services offered by third parties through the Website or links to other Internet assets.

6.6. The "Company" shall not be responsible for possible errors or security deficiencies that may arise from the use of a browser version that has not been updated, the activation of the password storing feature in the browser, or damage, errors or inaccuracies derived from its poor operation.

6.7. The "Company" shall not be liable for damages or losses caused to the user, for delays, errors or deficiencies during data transmission or download, platform unavailability, as well as faults or interruptions that may arise in the communication or alteration, destruction, inadequate or incorrect use as well as unauthorized data access.

6.8. The "Company" states that the Website has the necessary technology for access and/or use of services therein. However, the "Company" shall not guarantee continuous and permanent access to the Website by users; therefore the "Company" may interrupt access to the Website and use of the Service to modify or technically improve these. Therefore, it shall not be liable before the customer for any damages caused as a consequence of such interruption or the execution of technical modifications or improvements. In this sense, the acceptance of these Usage Conditions by the user imply the acceptance of permanent unavailability of the Website.

SEVEN.- MODIFICATION

7.1. The content of the Website and/or these Usage Conditions may be modified by the "Company" by making the modified Usage Conditions permanently available on the Website.

7.2. Users shall commit to read Usage Conditions each time they access the Website or Service. Hence, access to the website and service usage by users shall imply the acceptance of modifications that may have been made to the Usage Conditions or Website.
